Law和Equity

law与equity（衡平法）相对时应当译为“普通法”，此时其为 common law的缩略形式1.。这正如legal 与 equitable（衡平法上的）相对时应译为“普通法上的”一样道理2.。由此我们便得到legal charge（普通法上的担保）与equitable charge（衡平法上的担保）等，但翻译实践中，不少人都忽略了此种区别，一味只将legal 译为“法定”，或“合法”，这种作法当然不妥3.。同样，court of law 在一般情况下，译为“法院”即可；但其在与court of equity（“衡平法法院”）放置一起时，则应译为“普通法法院”4.。
